Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Paysagiste Luxart website (paysagisteluxart.com), our services, and any related applications (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services.




1. Definitions


“Client,” “you,” or “your” means any person or entity using our Services.“We,” “us,” “our,” or “Paysagiste Luxart” refers to Paysagiste Luxart, its affiliates, and subsidiaries.“Services” include all landscaping design, installation, maintenance, asphalt paving work, consultation, and any other offerings provided by Paysagiste Luxart, as well as access to the website and related digital tools.




2. Eligibility


You must be at least 18 years old and legally capable of entering into contracts in Québec, Canada, to use our Services. By using our Services, you represent and warrant that you meet these requirements.




3. Service Agreements


Estimates & ProposalsAll quotes, estimates, and proposals provided are valid for 30 days and may be subject to change thereafter.Written acceptance (email or signed document) is required before work begins.Scope of WorkThe scope, specifications, deliverables, and timeline for each project will be set out in a separate Service Agreement.Any changes or additions to the scope must be agreed upon in writing and may incur additional fees.Scheduling & AccessYou agree to provide Paysagiste Luxart reasonable access to your property, water, and power as needed to perform the Services.If access is denied or delayed, we may reschedule work and pass along any associated costs.




4. Payment Terms


Fees & DepositsA deposit of 20–50% of the project value may be required before work commences, as outlined in your Service Agreement. Final payment is due upon substantial completion of the work.InvoicesInvoices are payable within 15 days of issue.Late payments incur interest at 1.5% per month (18% per annum).Payment MethodsWe accept credit card, electronic funds transfer (EFT), and certified cheques.For online payments, processing fees (e.g., Stripe or PayPal fees) may apply.




5. Client Responsibilities


Provide accurate site information, including property boundaries, underground utilities, and any permits required.Obtain any necessary municipal or homeowners’ association approvals before work begins.Keep the work area clear of vehicles, personal items, and hazards.Notify us of any known site conditions (e.g., soils, drainage issues) that could affect performance.




6. Warranties & Disclaimers


Our WarrantyWe warrant that our workmanship will be free of defects for a period of 12 months from substantial completion.Warranty covers labor only; materials are covered by manufacturer warranties.ExclusionsDamage due to misuse, neglect, natural disasters, or third-party actions is not covered.Changes made by others after completion void this warranty.DisclaimerEXCEPT AS EXPRESSLY SET OUT HEREIN, THE SERVICES ARE PROVIDED “AS IS” AND PAYASGISTE LUXART DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.




7. Limitation of Liability


TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAYASGISTE LUXART’S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR THE APPLICABLE SERVICES. IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.




8. Intellectual Property


All content on the website (text, graphics, logos, images) is owned by or licensed to Paysagiste Luxart and is protected by copyright and trademark laws.You may view and download one copy of the materials solely for your personal, non-commercial use. Any other use requires our prior written consent.




9. Confidentiality


Each party agrees to keep confidential any proprietary or non-public information disclosed by the other party in connection with the Services. This obligation survives termination of the Service Agreement.




10. Termination


Either party may terminate a Service Agreement if the other party materially breaches its obligations and fails to cure within 14 days of written notice.Upon termination, you agree to pay for all work performed up to the termination date.




11. Governing Law & Dispute Resolution


These Terms and any Service Agreement are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein.Any disputes shall be resolved by binding arbitration in Montréal, Québec, under the rules of the Chambre arbitrale de commerce de Montréal, with each party bearing its own costs.




12. Changes to These Terms


We may update these Terms from time to time. Material changes will be posted to the website with a revised “Last updated” date. Your continued use of our Services after such changes constitutes acceptance of the new Terms.
